By accessing and using the Afic Tech Nest website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

Afic Tech Nest provides web development, mobile app development, digital marketing, and related technology consulting services. The specific scope, deliverables, and timelines for each project will be outlined in individual service agreements or statements of work.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of our services.
You agree to provide accurate, current, and complete information as required for the provision of services. You are responsible for maintaining the confidentiality of your account credentials.
You represent and warrant that you own or have the necessary rights to all content, materials, and information you provide to us for use in our services.
Timely feedback, approvals, and provision of required materials are essential for project success. Delays in client responses may affect project timelines and deliverables.
Project fees, payment schedules, and payment methods will be specified in individual service agreements. All fees are quoted in the currency specified in the agreement unless otherwise stated.
Unless otherwise agreed, payments are typically structured as: 50% upon project commencement, and 50% upon project completion. Milestone-based payment schedules may apply to larger projects.
Invoices not paid within 30 days may be subject to a late fee of 1.5% per month. We reserve the right to suspend services for accounts with outstanding balances.
All materials, content, and intellectual property provided by you remain your property. You grant us a limited license to use such materials solely for the purpose of providing our services.
Upon full payment, you will own all custom-developed deliverables created specifically for your project. Pre-existing materials, third-party components, and our proprietary tools remain our property or the property of their respective owners.
Unless otherwise agreed in writing, we reserve the right to display and link to completed projects as part of our portfolio and for promotional purposes.
You agree not to use our services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our systems or interfere with any other party's use of our services.
We warrant that our services will be performed in a professional and workmanlike manner consistent with industry standards. We will correct any defects or non-conformities reported within 30 days of delivery.
EXCEPT AS EXPRESSLY PROVIDED HEREIN, OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFIC TECH NEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES.
Our total liability for any claims under these terms shall not exceed the total amount paid by you for the specific services giving rise to the claim during the twelve (12) months preceding the claim.
You may terminate services at any time by providing written notice. You will be responsible for payment of all services rendered up to the termination date, plus any non-refundable expenses incurred.
We may terminate or suspend services immediately if you breach these terms, fail to make timely payments, or if we reasonably believe your use of our services may cause harm to us or others.
Upon termination, provisions relating to intellectual property, confidentiality, limitation of liability, and any accrued rights or obligations shall survive.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us. If the dispute cannot be resolved informally within 30 days, either party may proceed with formal dispute resolution.
